Terms of Service

1. Acceptance of Terms

By accessing or using climbit.lol (the “Service”), you agree to these Terms of Service (“Terms”), which form an agreement between you and the operator of climbit.lol (“we”, “us”). If you do not agree with any part of these Terms, please do not use the Service.

2. What the Service Is

climbit.lol is a free browser climbing game with public leaderboards. It has two tiers of participation:

• Free Climber Flags: players who reach peak altitudes can plant their username, a product name, a one-line message, and a URL on the public leaderboard at no cost.
• Paid Sponsor Billboard Bids: sponsors pay to display a brand name, link, and pitch on the sponsor leaderboard and on in-game Hyper-Portal billboard placements, ranked by bid amount. Bids start at $1.00 USD.

These Terms cover both free and paid use of the Service. There are no user accounts: you participate by submitting information directly.

3. Who May Use the Service

• You must be at least 13 years old to use the Service.
• You must be at least 18 years old — or have permission from a parent or legal guardian — to make any purchase.
• Information you submit (username, brand name, URL, pitch) must be accurate and must not impersonate another person or brand.

4. Payments for Billboard Sponsorships

Paid billboard bids are priced in US Dollars ($ USD) as displayed at checkout. All payments are processed by our Merchant of Record, Dodo Payments, which handles checkout, billing, tax collection, and invoicing. We never receive or store your full card number, CVV, or banking credentials — payment details go directly to Dodo.

By submitting a bid and completing payment, you authorize Dodo Payments to charge your selected payment method for the displayed amount. A sponsorship placement begins as soon as payment is confirmed, which is why refunds are limited to the cases described in our Refund Policy.

5. Your Content & Licence

You keep ownership of everything you submit (names, pitches, URLs, linked material). However, by submitting content you grant us a worldwide, royalty-free licence to display, reproduce, and publish it on the Service for the duration of your placement — this is the entire purpose of the leaderboard and billboards.

You are solely responsible for the content you submit and for the destinations of any URLs you provide. You warrant that your submissions do not violate any law or the rights (including intellectual-property and privacy rights) of any third party.

6. Acceptable Content & Moderation

You may NOT submit any username, brand name, pitch, URL, or linked content that is:

• Illegal, fraudulent, misleading, or deceptive.
• A malicious link — phishing sites, malware, spyware, or scam operations.
• Hate speech, harassment, sexually explicit material, or violent content.
• Infringing any third party’s intellectual property or privacy rights.
• Impersonating another person, brand, or the Service itself.

We may remove or delist any submission that violates these standards, with or without prior notice. For paid sponsorships, removal for a violation of this Section 6 is not eligible for a refund.

7. Live Ranking — What a Bid Buys

Billboard ranks are dynamic. When another sponsor places a higher bid, that sponsor takes the higher rank and placement. A bid guarantees a placement on the board, ranked according to your bid amount at the time — it does not guarantee any fixed rank or the #1 position for any period of time. Rank movement caused by other participants’ bids is an intended mechanic, not a defect.

8. Availability & Changes to the Service

We work hard to keep the Service running, but it is offered without guarantee of uninterrupted availability. We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If a paid sponsorship cannot be delivered at all due to such a change, see our Refund Policy for the affected cases.

9. Disclaimers & Limitation of Liability

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the placement giving rise to that claim (or $0 if you made no payment).

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Governing Law & Disputes

These Terms are governed by the laws of India. Before starting any formal proceedings, please contact us first — most problems can be solved quickly by email, and we commit to responding to dispute notices in good faith within 30 days. Subject to that, courts located in India have exclusive jurisdiction over any disputes arising from these Terms or the Service.

11. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date above always shows the current version, and material changes will be reflected on this page. Continuing to use the Service after an update means you accept the revised Terms.
